This Acceptable Use Policy ("AUP") supplements the Terms of Service between You and WebGrowly LLC. By using the Service, You agree to comply with this AUP. Violation of this AUP may result in immediate suspension or termination of Your account without refund, and may expose You to civil or criminal liability.
1. Illegal and Harmful Conduct
You may not use the Service to:
- Violate any applicable federal, state, or local law, rule, or regulation, including real estate licensing laws administered by the Florida Real Estate Commission (FREC).
- Engage in fraud, misrepresentation, or deceptive business practices.
- Infringe any intellectual-property, publicity, or privacy right of any person or business.
- Transmit malware, viruses, ransomware, trojans, worms, or any other malicious code.
- Harass, stalk, threaten, defame, or intimidate any person.
- Engage in or promote human trafficking, child sexual abuse material, terrorism, or violent extremism.
2. Fair Housing and Non-Discrimination
The Service must not be used in a manner that violates fair-housing law. Specifically, You may not:
- Use AI-generated listing descriptions, chat widgets, email or SMS templates, audience-targeting tools, or any other Feature to discriminate, steer, or advertise in a manner that violates protected classes under the federal Fair Housing Act (race, color, religion, sex (including sexual orientation and gender identity per applicable HUD guidance), national origin, disability, familial status) or the Florida Fair Housing Act.
- Configure the AI Chat Widget, lead-scoring logic, or any automated decision-making to screen prospects by protected class, proxy for protected class (including ZIP-code or neighborhood proxies used to exclude protected groups), or otherwise produce discriminatory outcomes.
- Publish or transmit language that expresses a preference, limitation, or discrimination based on protected class.
You are responsible for reviewing all AI output before using it publicly or with clients.
3. Telemarketing and Messaging
You may not use the Service, including the AI Follow-Up Composer, contact forms, SMS integrations, or any messaging Feature, to:
- Send SMS, MMS, WhatsApp, voicemail drop, or email to any recipient without prior express consent as required by the Telephone Consumer Protection Act (TCPA), Florida Telephone Solicitation Act (Fla. Stat. § 501.059), and CAN-SPAM Act.
- Send any marketing, promotional, or advertising SMS, MMS, or voice message without prior express written consent that meets the standard in 47 CFR § 64.1200(a)(2), including a clear and conspicuous disclosure that: (i) identifies the sender; (ii) discloses that the recipient will receive auto-dialed or pre-recorded marketing messages; (iii) states that consent is not a condition of purchase; and (iv) includes instructions to opt out. Obtaining informal or verbal agreement does not satisfy this standard.
- Send messages during hours prohibited by law.
- Send messages that do not include required disclosures, sender identification, or opt-out mechanisms.
- Ignore, delay, or circumvent opt-out requests.
- Upload purchased, harvested, or scraped contact lists.
- Use the Service to engage in "scraped lead" remarketing without a preexisting business relationship or express consent.
4. MLS, IDX, and Third-Party Data
You are solely responsible for compliance with the terms of service, data-licensing rules, and redistribution restrictions of any Multiple Listing Service (MLS), IDX feed, or third-party source (Zillow, Redfin, Realtor.com, or any other) whose data You access through the Service (including through the Smart Extract Feature). You may not:
- Extract, cache, store, or redistribute MLS or IDX data in a manner that violates Your licensing agreement with Your MLS or the third-party source.
- Use the Service to circumvent MLS access controls, rate limits, or pay-walls.
- Misattribute, relabel, or strip attribution from data sourced from a third party in a manner inconsistent with its license.
5. Service Integrity
You may not:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measure, except through an authorized security-research channel disclosed in writing.
- Access the Service through automated means beyond those expressly provided by WebGrowly (including the Zapier integration, where available, and any other programmatic access WebGrowly expressly enables for Customer).
- Scrape, crawl, or systematically extract data from the Service other than through permitted export tools.
- Bypass, disable, or interfere with rate limits, quotas, billing, or usage tracking.
- Use the Service to build, train, or improve a competing product, including machine-learning models.
- Mirror, frame, or embed the Service on a third-party property without our prior written consent.
- Remove or alter any proprietary notice or branding.
6. Account and Credential Hygiene
You may not:
- Share, sell, transfer, rent, or sublicense Your account or credentials.
- Create an account under a false identity or impersonate any person or entity.
- Permit any other natural person (including assistants, team members, brokerage colleagues, transaction coordinators, or any other third party) to access, use, or log into Your account.
- Use the Service after Your account has been suspended or terminated.
The Service is sold and provided for use by a single individual real estate professional. Each real estate professional who uses the Service must maintain a separate customer account and pay a separate License Fee, as described in Section 3.2 and Section 7 of the Terms of Service. The Service does not support brokerage accounts, team accounts, shared accounts, or multi-agent configurations.
7. Content Standards
You may not submit, upload, or transmit through the Service:
- Content that is unlawful, defamatory, harassing, or obscene.
- Content that infringes any third party's intellectual-property, trademark, publicity, or privacy right.
- Content that contains a credit-card number, bank account number, Social Security number, passport number, driver's license number, or other sensitive identifier, except where a specific Feature is designed to process such information and You have verified consent.
- Content that You do not have the right to submit under an applicable agreement (including employer, broker, or MLS agreement).
- Voice recordings of individuals who have not consented to being recorded under applicable law.
8. Platform Resources
You may not:
- Overload, flood, spam, or otherwise disrupt the Service's servers or networks.
- Exceed the rate limits and usage quotas documented in the Service (leads per month, AI messages per month, API requests per minute).
- Use the Service in a manner that is harmful or disruptive to other customers.
9. Cooperation
You agree to cooperate with any investigation we conduct into a suspected violation of this AUP, including providing timely access to logs, account configurations, or other relevant information, and complying with our remedial instructions.
10. Enforcement
We may take any action we deem appropriate in response to a violation of this AUP, including:
- Issuing a warning;
- Removing, disabling, or modifying offending content or configuration;
- Suspending the Feature at issue;
- Suspending Your account;
- Terminating Your account without refund;
- Reporting the conduct to law enforcement or a regulatory body;
- Pursuing civil remedies.
Our enforcement decisions are at our reasonable discretion.
11. Reporting Violations
To report a suspected violation of this AUP, email report@webgrowly.com with the subject line "AUP Report" and sufficient detail for us to investigate. To report a security vulnerability, email security@webgrowly.com with the subject line "Security Report" (see also Section 26 of the Terms of Service).
12. Changes
We may update this AUP from time to time. Material changes will be notified to Customers as provided in Section 21 of the Terms of Service.
